1. Who you are contracting with

These Terms of Service ("Terms") are a binding agreement between you and PathLingua.com ("PathLingua", "we", "us") governing your access to and use of our websites, applications, content, and related services (the "Service").

2. Acceptance

By creating an account or continuing to use the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation. If you are an individual, you represent that you are of legal age in your jurisdiction.

3. The Service

PathLingua provides online language-learning tracks, lessons, AI-assisted practice, placement testing, and certificates of completion. Features available to you depend on your plan (free or Pro).

You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly if you suspect unauthorised access.

6. AI-assisted features

The Service includes AI-generated content (e.g. practice prompts and feedback). You are responsible for the prompts you submit and for verifying outputs before relying on them. Outputs may be inaccurate and are not a substitute for professional advice. You must not use AI features to generate unlawful, infringing, harmful, or abusive content, and we may filter, restrict, or remove content and suspend accounts for repeated or serious violations.

7. Intellectual property

PathLingua and its licensors own the Service, including the software, course content, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. You retain ownership of content you submit; you grant us a limited licence to host and process it solely to provide the Service.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, tax, cancellations, refunds, and renewals are governed by the Paddle Checkout Buyer Terms in addition to our Refund Policy.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account; access continues until the end of the paid period.

We work to keep the Service available and performant but do not guarantee uninterrupted or error-free operation. We may modify or discontinue features over time.

10. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. You may close your account at any time. On termination, your right to use the Service ends and we may delete your data after a reasonable retention period.

11. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the twelve months preceding the claim, and we are not liable for indirect, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation would be unlawful.

12. Indemnity

You agree to indemnify PathLingua against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

13. Changes

We may update these Terms from time to time. Material changes will be notified through the Service or by email; continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which PathLingua.com is established, without regard to conflict-of-laws principles. Disputes will be brought before the competent courts of that jurisdiction, unless mandatory consumer-protection law provides otherwise.
